I won an ebay auction for some free gift football cards from Adventure recently, the envelope arrived this morning in a plastic bag, apologizing for the Post Office having mutilated said envelope.
The cards were missing.
Can anyone give me a good reason not to have a walk along the street and heave a brick through the Post Office window?

Gutted for you! Such an annoyance when this happens, you did your bit, the seller did theirs and still the fates conspire to send it hurtling off the tracks!

I did check with the seller to make sure he had enclosed the cards (of course he had but I had to ask),
he kindly said he would have a look through his stash of cards and send me some others free. Nice gesture I thought.

It's Royal mail who deliver the mail, not Post Office, so you'd have to heave a brick through your local Royal Mail delivery office.

Depending on how the cards were posted (e.g. seller got a receipt), you may be able to get some money back from Royal Mail.

I've just been told that I should have claimed through ebay, then I would have got a full refund from the seller. Apparently its the sellers responsibility to ensure I get the goods, even though the Royal Mail caused the problem. We all know now for next time.

Failing that, is the seller going to give you anything back?
Bad luck for the seller perhaps but it is not your fault that the cards were missing on arrival. One could even argue that if the seller had packaged the cards up better then it wouldn't have happened.
I sold some Action Man accessories a while back and like your seller, I did not have a receipt of postage so couldn't claim from Royal Mail. Unfortunately the package got damaged which broke a couple of items inside.
We both agreed it was Royal Mail's fault due to mishandling but I still gave the buyer a partial refund as fair play.

Yes the seller did send me some replacement cards.
However I've since bought some more cards from him, which have not arrived yet after being posted a week ago, and guess what, he hasn't got a postal receipt for them either.
He says he's sent me a replacement lot today by special/recorded/tracked/signed for etc etc post. I'm getting the feeling I'm missing something here, and its not just the cards.

The second lot will be all ones I want, however the first lot of replacements only had 2 that I wanted out of 6 he sent.

That's 100% correct and I think you have up to 30 days to claim your money back. It's the seller's responsibility to ensure his items get to you so he should have got proof of postage so he can claim back from the Royal Mail. It's only happened to me every hundred or so trades but it has happened both ways and I've both refunded the buyer and claimed from the RM and been reimbursed by the seller and they've claimed. The only trouble about getting eBay involved is that you will be expected to send Lot 1 back and because you will want proof that it does get returned, then it will have to be signed for. I would suggest contacting the seller again. If they are a decent seller then they will want to settle the matter quickly and quietly. Even a partial refund may be more in the pocket than a full one minus your postage. Of course, it depends how much you paid.
Of course you could resort to eBay if that fails.
